The Council of Ministers has approved a decree law that creates sick leave for debilitating menopause and for victims of gender violence, and expands widowhood and orphanhood pensions.

The Council of Ministers approved this Tuesday a decree law that expands the rights and benefits of the Social Security. According to heraldo.es, the package includes new situations of temporary incapacity, improvements in widowhood and orphanhood pensions, and more aid for families, measures that the Government had already announced.

The new sick leave for debilitating menopause and for victims of gender violence will not require a waiting period and will be paid from the day after the leave begins. The benefit will be 60 % of the regulatory base until the 20th day of the leave and 75 % from that date onwards.

Those affected by catastrophic events, such as the dana, will have another situation of temporary incapacity, both employees and self-employed. In these cases, the leave will be treated as if it were due to a work accident.

In widowhood pensions, the decree facilitates access for de facto couples with children in common who can prove two years of cohabitation, even if they are not registered. Those who have lost their partner before the approval will have one year to apply for the benefit.

The orphanhood pension will increase to double the minimum interprofessional wage when the mother has died due to violence against women. Extraordinary pensions for terrorist acts cannot be less than 2,442 euros, which is 36 % more than before.

The decree also improves the CUME benefit, which can be received by both parents alternatively or simultaneously, with a subsidy of 50 % of the regulatory base. In cases of greater vulnerability, it will be maintained beyond 26 years if the affected person has a degree III dependency or a disability equal to or greater than 65 %.

In the Special Regime for Sea Workers, the subsidy for birth and care of minors is extended to parents and its duration increases to 19 weeks. Additionally, the food payment guarantee fund triples the maximum advance per beneficiary, from 100 to 300 euros, and extends its duration.
