SEPE allows the subsidy for those over 52 to be combined with personal incomes of up to 75% of the SMI, set at 915.75 euros per month in 2026. Unlike other subsidies, only the applicant's income is taken into account, not that of their family unit.
Beneficiaries of the subsidy for those over 52 will be able to continue receiving the benefit even if they have personal incomes of up to 915.75 euros per month, equivalent to 75% of the Minimum Interprofessional Wage (SMI). This is stated in the regulations of the State Public Employment Service (SEPE), as published by elcorreo.com.
This limit applies to the three main subsidies: the exhaustion of contributory benefits, the insufficiency of contributions, and the one aimed at those over 52. However, this last one has a key difference: it only counts the income of the recipient, not that of the family unit, so high earnings from a partner or children living with them do not affect it.
The subsidy for those over 52 consists of a monthly payment of 480 euros and a contribution of 125% on the minimum base. It is aimed at unemployed individuals who have lost their jobs close to retirement age and who already meet the Social Security requirements to access a pension, except for having reached the ordinary age.
The calculation of income deficiency distinguishes between actual and presumed earnings. The former includes rents, non-contributory pensions (pro-rating extra payments), lottery winnings, or interest from funds. In the case of severance pay, only the portion that exceeds the minimum of the Workers' Statute is counted.
Presumed earnings apply, for example, to a second home that is not rented out, to which the current legal interest rate is attributed, set at 3.25% this year, pro-rated over twelve months. If the sum of both types of income does not exceed 915.75 euros per month, the requirement is met. The applicant must submit a responsible declaration along with the application.
Additionally, the Royal Decree regulating this benefit allows the subsidy to be combined with employment as long as the gross salary does not exceed 2,225 euros per month (375% of the IPREM), which equates to 31,500 euros annually in 14 payments. The maximum time for this compatibility is six months, and the amount varies depending on the type of contract and the quarter of the benefit.
The Minimum Vital Income (IMV) is also compatible. In these cases, the assigned amount is reduced by the 480 euros from the subsidy, and the INSS pays the difference. The amounts of the IMV range from 733.60 euros for a single adult to 1,613.92 euros for large family units.
To access the subsidy for those over 52, it is necessary to be registered as a job seeker, have exhausted unemployment benefits or have at least 90 countable contribution days, be at least 52 years old, and meet the retirement requirements except for age. It is also required to have contributed for at least 15 years, two of which must be in the last 15, and six years of unemployment in Spain.
"The applicant must present these accounts in a responsible declaration attached to the application"
The responsible declaration is submitted along with the application, and SEPE periodically checks that the requirements are maintained. If the income limit is exceeded, the aid is suspended.
