The Superior Court of Justice of Andalusia confirms that a few hours trip to Morocco interrupted the registration required to receive the Active Insertion Income.
The Superior Court of Justice of Andalusia (TSJA) has confirmed the withdrawal of the Active Insertion Income (RAI) from a jobseeker in Melilla, as reported by que.es. The court considers that a few hours trip to Morocco interrupted the registration as a job seeker required for the aid.
The State Public Employment Service (SEPE) had suspended the payment after detecting the exit from the country while reviewing the file. The trip was a same-day round trip, but the regulation requires being registered as a job seeker for twelve consecutive and uninterrupted months before applying for the RAI, and the agency understood that this continuity was broken.
The TSJA does not assess whether the man was actively looking for work, but whether he met the formal requirement at the time of requesting the aid. According to the ruling, he did not meet it, and it supports the SEPE's decision.
The RAI is a monthly aid aimed at long-term unemployed individuals who meet certain requirements. The regulations in force at the time of the application did not contemplate exceptions for short trips abroad, according to the case analyzed.
For those living in Melilla or Ceuta and receiving this aid, the ruling means that crossing the border, even for a short time, can have consequences on the payment. Before leaving the country, it is advisable to consult with the SEPE how the trip affects registration and the benefit.
