A court in Santiago de Compostela declares the clauses of a CaixaBank revolving credit card with an APR of 28.32% null and orders the bank to refund the excess charges. The ruling is final.
A resident of Santiago de Compostela has recovered €2,019.68 from CaixaBank, as reported by lawandtrends.com, following a ruling that nullifies the clauses regulating the interest and payment system of her Visa & Go credit card.
The decision, issued by the Court of First Instance of Santiago de Compostela, upholds the claim presented by the law firm Oulego Abogados y Consultores. The bank must refund the amounts improperly charged along with the corresponding interest and bear the legal costs, meaning the client will not pay any attorney or representative fees.
The card was contracted in 2018 and operated on a revolving system. With an APR of 28.32% and a monthly payment of €20, a significant portion of each payment went towards interest, while the outstanding principal decreased very slowly.
According to the court, CaixaBank did not prove that it had sufficiently informed the client about the economic consequences of the contract, particularly the risk of prolonging the debt and the minimal amortisation of the principal. The ruling applies the doctrine of the Supreme Court established in its rulings of 30 January 2025 regarding the transparency of revolving credit card contracts.
José Ramón Oulego Erroz, managing partner of Oulego Abogados y Consultores, believes the issue extends beyond the interest rate:
“The fundamental issue is transparency. A consumer has the right to know how much the credit will actually cost them, how their debt is amortised, and what economic consequences may arise from choosing a reduced monthly payment.”
The firm notes that claims may affect other revolving products from different entities and that cancelling the card or finishing paying it off does not, in principle, prevent a claim from being examined. Each case, it warns, must be reviewed individually, as it depends on the agreed conditions and the information provided to the client.
