A taxpayer will face a surcharge of over €4,000 for having paid 4 cents less than the outstanding tax debt. The Taxpayer Defence Council proposes a tolerance margin of three euros.
A taxpayer will have to pay a surcharge of over €4,000 for having deposited €23,417.43 instead of the €23,417.47 demanded by the Tax Agency, a difference of just four cents. The case, as reported by eldia.es, has been shared by Dani (@taxingplanner), an expert in personal income tax, and is also included in the Annual Report of the Taxpayer Defence Council for 2025.
The debt was paid outside the voluntary deadline. In such cases, the General Tax Law provides for a 5% surcharge if the total is paid before the enforcement notice is issued. Since the payment did not cover the full amount, the Administration applied the ordinary enforcement surcharge of 20%, about €4,683.49, not including possible interest.
The Tax Office believes that the action aligns with the literal interpretation of the regulation. The Taxpayer Defence Council, an agency under the Ministry of Finance that reviews citizens' complaints, has proposed to that ministry a tolerance margin of three euros for small amounts left unpaid due to obvious human errors.
For the taxpayer, the case indicates that an incomplete amount is treated as an outstanding debt even if the difference is minimal, so it is advisable to check the exact figure before confirming a payment.
